Establishment

The Committee shall have the power to incorporate or appoint a member with relevant skills to become a Committee member when resolving any issue among members.

The mandate and tenure of any constituted Disciplinary Committee is two (2) years

Quorum

  • The quorum necessary for the transaction of business shall be three.
  • A duly convened meeting of the Committee at which a quorum is present shall be competent to exercise all or any of the authorities, powers and discretions vested or exercisable by the Committee.

Roles

The disciplinary committee and subsequent panel’s role is to:

  1. Hear investigation reports and findings from misconduct investigations carried out by the Caucus Forum members
  2. Undertake and be the sole body where complaints, disputes are reported to as and when they occur.
  3. The Committee and its decisions shall be independent but may open window for consultation with the leadership of the forum.
  4. The Committee may consult the leadership on any matter reported and whether such matter amounts to acts of misconduct, dispute or an issue that warrant attention.
  5. Consider the points raised through the investigation and base their conclusion on the ‘balance of probability’.
  6. Impose disciplinary and performance decisions to members and partners whose conduct was below acceptable standards.
  7. Report on the results of disciplinary panel hearings to the Executive Committee.
  8. Provide appropriate feedback to support decisions made at disciplinary panels.
  9. Developing guidance and criteria that will enable them to fairly and consistently determine if sanctions, outcomes and remedial actions are required and the level and type of disciplinary and performance sanction .
  10. May appoint investigators/panel from the members of the committee to hear all investigation reports and findings from investigations conducted by any member.
  11. Clearly and effectively communicate conclusions and decisions to impose or not impose any disciplinary or performance sanctions, outcomes and remedial actions to members and partners following disciplinary panel proceedings.
  12. Reviewing and ensuring consistency is achieved in disciplinary decisions made, including disciplinary or performance sanctions, outcomes and remedial actions imposed, to ensure they are consistently and fairly applied.
  13. Reviewing disciplinary policies and procedures and making recommendations, where appropriate to the office of the Chairperson of the Caucus Forum, when required.
  14. Ensure periodic reports as shall or may be necessary.
